Last updated: 1 August 2026
These Terms of Sale and Website Use (“Terms”) govern access to the ARCHIVE 77 website and purchases from ARCHIVE 77, The seller is Alon Kalmanovich, an Israeli sole trader registered as an exempt dealer (osek patur), registration number
216434258, trading as ARCHIVE 77. (“ARCHIVE 77”, “we”, “us” or “our”).
Shopify provides the ecommerce platform. Tapstitch and other contracted providers may manufacture, print, pack and ship products on our behalf. Your purchase contract is with ARCHIVE 77, not with Shopify, Tapstitch, a carrier or any other service
provider.
1. Scope and mandatory rights
These Terms apply to consumers in Israel, the European Union, the United Kingdom, the United States and Canada. The Regional Addenda form part of these Terms. Nothing in these Terms excludes, restricts or waives a right or remedy that cannot
lawfully be excluded under the law applicable to you. If a Regional Addendum provides greater protection, it prevails.
2. Eligibility and personal use
You must have legal capacity to enter into the purchase contract. Products are sold for personal or household use unless we expressly approve a business order in writing. You may not use the website unlawfully, interfere with its security, scrape it in
breach of applicable law or our technical controls, or misuse our intellectual property.
3. Product information
We take reasonable care to describe products accurately. Screen settings, lighting and production batches may cause minor colour variations. Garment measurements may vary within the clearly disclosed manufacturing tolerance. Such minor variations
do not affect your mandatory rights where the product is defective, unsafe, materially different from its description, or not of the quality required by applicable law.
4. Orders and contract formation
Your order is an offer to purchase. An automated acknowledgement confirms receipt only. The contract is formed when we send an order acceptance or production confirmation, whichever occurs first. We may reject an order before acceptance for a
legitimate reason, including unavailability, a clear pricing error, failed payment, suspected fraud, sanctions or export restrictions, an undeliverable address, or a quantity restriction. If payment was taken for an order we reject, we will promptly refund it.
5. Order review and cancellation before production
You must review product, size, colour, personalisation, shipping address and contact details before submitting the order.
Contact us immediately to request a correction or cancellation. We will use reasonable efforts to stop production, but can not guarantee a change after production has begun. This clause does not limit statutory cancellation or defect rights.
6. Prices, taxes and charges
Prices are displayed in the currency selected at checkout. Before you place the order, we will display the product price, shipping charge, taxes we collect, and the total payable to us. Import VAT, customs duty, brokerage or local charges not collected at
checkout may be payable by the recipient where clearly disclosed before purchase. We will not add undisclosed mandatory charges after the order.
7. Payment
You authorise us and our payment processors to charge the selected payment method. We do not normally receive full payment-card details. You must provide accurate billing information and be authorised to use the payment method. A payment
authorisation is not acceptance of an order.
8. Promotions
Promotions apply only for their stated period and conditions, cannot be combined unless stated, have no cash value, and may be withdrawn prospectively. A promotion will not reduce mandatory refund rights. We may correct a manifest error but will not
charge a higher price without your express agreement.
9. Delivery
Production and delivery are governed by the Shipping and Delivery Policy. Unless the law permits otherwise, risk of loss or damage remains with us until the product is physically delivered to you or a person you identify to take possession. If you
independently appoint a carrier that we did not offer, risk may pass when the goods are handed to that carrier, but only to the extent permitted by applicable law.
10. Inspection and problems
Inspect the parcel promptly. Notify us as soon as reasonably possible of loss, damage, a wrong item, a manufacturing defect or material non-conformity, and provide photographs where reasonably available. A reporting request does not shorten a
mandatory limitation or guarantee period.
11. Returns and refunds
Returns, cancellations, exchanges, repair, replacement, price reduction and refunds are governed by the Returns, Refunds and Exchanges Policy and the applicable Regional Addendum.
12. Intellectual property
The website, designs, logos, artwork, photographs, text, software and other content are owned by us or our licensors and are protected by applicable intellectual-property laws and treaties. You receive no ownership right. You may use the website for
lawful personal shopping only. You may not reproduce, commercially exploit, remove rights notices from, or create derivative works from protected content without permission.
13. Consumer-supplied content
If you upload or supply a design, image, name, logo or text, you retain ownership but grant us and our fulfilment providers a limited, worldwide, royalty-free licence to use, reproduce, adapt and transmit it solely to process, manufacture, fulfil, support and
document your order. You represent that you have the necessary rights and that the content is lawful. We may reject unlawful, infringing, hateful or unsafe content. You are responsible for third-party claims caused by content you supplied, except to the
extent caused by our conduct or prohibited by consumer law.
14. Reviews
Reviews must reflect genuine experience. We may moderate unlawful, abusive, irrelevant, privacy-invasive or demonstrably fake content, but will not suppress a genuine negative review merely because it is negative. Incentivised reviews, if any, must disclose the incentive.
15. Website availability and third-party services
We may maintain, update or suspend website features. Links and optional third-party services are provided for convenience. We are not responsible for an unaffiliated third party’s separate service, but remain responsible for obligations that applicable law
places on us as seller.
16. Product safety and recalls
Do not use a product contrary to its care label or safety warning. Notify us of a safety concern. We may contact customers, suspend sales, issue instructions, replace products or conduct a recall. Nothing limits liability that cannot be excluded for an
unsafe or defective product.
17. Disclaimers
To the fullest extent permitted by applicable law, we do not warrant that the website will always be uninterrupted or error-free. Products remain subject to all mandatory statutory warranties, guarantees and conformity rights. We do not exclude implied
terms where exclusion is prohibited.
18. Limitation of liability
Nothing limits liability for fraud, fraudulent misrepresentation, wilful misconduct, gross negligence where it cannot be limited, death or personal injury caused by negligence where exclusion is prohibited, defective-product liability that cannot be excluded,
breach of data-protection duties that cannot be limited, or any mandatory consumer remedy. Subject to those exceptions and to applicable law, we are not liable for indirect or consequential commercial losses that were not reasonably foreseeable when the contract was made. This limitation does not reduce a refund, repair, replacement, price-reduction or delivery remedy owed to a consumer.
19. Indemnity for unlawful commercial misuse
If you use the website for unauthorised commercial activity or knowingly provide infringing content, you will reimburse reasonable third-party losses directly caused by that conduct, after notice and a reasonable opportunity to participate in the
defence. This clause does not apply to ordinary consumer use, our negligence, or any liability that cannot lawfully be shifted.
20. Suspension and termination
We may suspend access for fraud, security threats, unlawful conduct or material breach. Suspension does not affect an accepted order unless fulfilment would be unlawful or unsafe. We will refund an unfulfilled lawful order that we cancel.
21. Changes
The version in force when an order is accepted governs that order. We may update these Terms for future use. Material changes will not retroactively reduce rights for an existing order.
22. Governing law and disputes
These Terms are governed by Israeli law, excluding conflict-of-law rules, except that this choice does not deprive a consumer of mandatory protections available under the law of the consumer’s habitual residence. Courts in Israel have non-exclusive
jurisdiction, subject to any mandatory right to sue or defend in another competent forum. Before filing a claim, the parties should attempt in good faith to resolve it through customer support. This clause does not require arbitration and does not waive classaction or small-claims rights where such a waiver is unenforceable.
23. Severability and no waiver
If a provision is invalid or unenforceable, it will be enforced to the maximum lawful extent or severed, while the remainder continues. Failure to enforce a provision once is not a waiver.
24. Assignment
You may not transfer an order without consent. We may transfer the business or these Terms as part of a bona fide reorganisation or sale, provided this does not reduce consumer rights and required notice is given.
